# Surety Bond Claims **What happens when a surety bond claim is filed?** The obligee files the claim with the surety, which investigates before paying anything. If the claim is valid, the surety pays it up to the bond amount, and the principal must then reimburse the surety under the indemnity agreement. Many claims resolve at the investigation stage without payment, which is why early notice matters. ## How a surety claim works A surety bond protects the obligee (the state, court, or counterparty named on the bond), not the principal (you). When the obligee believes the principal has failed to perform, they file a claim with the surety. The surety investigates, and if the claim is valid, pays it up to the bond amount. The principal then reimburses the surety under the indemnity agreement signed at placement. ## Three parties, three roles - **Obligee:** the party the bond protects. Files the claim. - **Principal:** the party who posted the bond. Owes the underlying obligation and, if the surety pays, owes the surety reimbursement. - **Surety:** the bonding carrier.
